Terms of Service

Last Updated: January 1, 2025

1. Agreement to Terms

By using ElectricRates.org ("Service"), you agree to these Terms. If you disagree, do not use the Service.

2. Service Description

ElectricRates.org provides automated electricity rate monitoring and supplier switching services in deregulated energy markets. We act as an authorized agent to:

  • Monitor competitive electricity supply rates
  • Switch your electricity supplier when rates are favorable
  • Manage supplier enrollments and renewals

IMPORTANT: We do not guarantee savings. Electricity rates fluctuate based on market conditions.

3. Letter of Authorization

By enrolling, you authorize us to:

  • Act as your agent for electricity supply matters
  • Access your utility account information
  • Switch suppliers on your behalf
  • Receive commission from suppliers

This authorization remains effective until revoked in writing.

4. No Guarantee of Savings

WE DO NOT GUARANTEE YOU WILL SAVE MONEY. Electricity rates change frequently. While we only switch when competitive rates are lower than utility rates at the time of switching, subsequent rate changes may result in you paying more than utility default rates.

5. Supplier Contracts

When we enroll you with a supplier, you enter a contract with that supplier, not with us. Supplier contracts may include:

  • Fixed or variable rates
  • Contract term lengths
  • Early termination fees
  • Auto-renewal provisions

6. Cancellation

You may revoke your authorization at any time by:

Cancellation does not automatically cancel existing supplier contracts, which may have their own termination procedures and fees.

7. Commissions and Fees

Our service is free to you. We receive commissions from energy suppliers when we enroll customers. These commissions may affect the rates offered to you.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT:

  • Continuous savings on electricity costs
  • Uninterrupted service
  • Error-free operations
  • Specific results

9. Limitation of Liability

WE ARE NOT LIABLE FOR:

  • Higher electricity costs resulting from market changes
  • Supplier contract terms or performance
  • Utility service interruptions
  • Indirect, incidental, or consequential damages

Our maximum liability is limited to $100.

10. Indemnification

You agree to indemnify us from claims arising from:

  • Your breach of these Terms
  • Your violation of applicable laws
  • Disputes with energy suppliers
  • Inaccurate information you provide

11. Governing Law

These Terms are governed by Ohio law, without regard to conflict of law principles.

12. Arbitration

Disputes will be resolved through binding arbitration under AAA rules, except you may pursue claims in small claims court.

13. Changes to Terms

We may modify these Terms with 30 days notice via email or website posting.
